2. The petitioner seeks bail in Shahpur P.S. Case No. 265 of 2025 registered for the offences under Sections 109 and 3(5) of the Bharatiya Nyaya Sanhita (BNS), 2023 read with Section 27 of the Arms Act.

3. The allegation is that the informant was shot by two persons sitting on a motorcycle which was being driven by the petitioner.

4. Learned counsel for the petitioner submits that a land dispute has been ongoing between the parties for a long time. He further submits that the petitioner is not the actual assailant, has been in custody since 25.02.2026, and has no criminal antecedents.

5. Learned counsel for the Informant and the learned

Patna High Court CR. MISC. No.36106 of 2026(3) dt.08-07-2026 2/2 Additional Public Prosecutor for the State have vehemently opposed the prayer for bail of the petitioner.

6. Considering the backdrop of a land dispute, the fact that the petitioner is not the assailant, and that he has been in custody since 25.02.2026 with no criminal antecedents, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Subdivisional Judicial Magistrate, Danapur, Patna in connection with Shahpur P.S. Case No. 265 of 2025.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner. (Ansul, J) Vikash/- U T
