JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. 9.50 kg. ganja is said to have been recovered from Bathan of the petitioner and submission on behalf of the petitioner is that one co-accused, Vijay Mahto, against whom there was allegation that aforesaid ganja was brought by him, has already been granted privilege of bail by a co-ordinate Bench of this court vide order dated 17.10.2014 passed in Cr. Misc. No. 15703 of 2014 whereas petitioner is in jail custody for near about one year without having any criminal antecedent.
Regard being had to the facts and circumstances of the case as well as submissions of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in
Patna High Court Cr.Misc. No.4773 of 2015 (4) dt.16-10-2015 2/2 connection with Sonepur P.S. Case No. 396 of 2013 pending in the court of Additional Sessions Judge-I, Saran at Chapra stands rejected.
However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible.
