JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier, prayer for bail of the petitioner was rejected by this court vide order dated 21-04-2015 passed in Cr. Misc. No. 3616 of 2015 but submission on behalf of the petitioner is that having similar allegation, one co-accused namely, Chandan Kumar has already been granted privilege of bail by a coordinate bench of this court by order dated 24-06-2015 passed in Cr. Misc. No. 24060 of 2015 after completion of one year in jail custody and so far as petitioner is concerned; he is in jail custody since 04-052014 i.e. for more than one year. The trial court has reported that uptill now, only one prosecution witness could be examined.
