1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner apprehends his arrest in connection with Riga P.S. Case no.464 of 2023 registered under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.

3. A perusal of F.I.R and seizure list would show a total of 972 liters of nepali liquor was recovered from a Scorpio bearing Registration No. BR06P913.

4. Learned counsel for the petitioner submits that F.I.R was lodged against unknown. As per owner book of the said Scorpio vehicle, the name of one Abdul Sattar appeared to be the owner of the said vehicle, however, the said vehicle was sold to the petitioner but the papers were not transferred. Later

Patna High Court CR. MISC. No.35105 of 2025(3) dt.03-07-2025 2/3 on the petitioner also sold the said vehicle to one Rohit Kumar by entering into an agreement of sale between them. It has further been submitted that no recovery has been made from the physical or conscious possession of the petitioner and the petitioner has no knowledge that the the said vehicle was put to any illegal use. The petitioner has no criminal antecedent and undertakes to cooperate in the case/trial.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

In view of the aforesaid facts of the case, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Riga P.S. Case no.464 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023 and subject to the following conditions:- (I) One of the bailors of the petitioner shall be the family member/close relative of the petitioner.
