JUSTICE SUDHIR SINGH ORAL ORDER 26-10-2016 The present modification application has been filed for modification of the order dated 30.03.2016 passed in Cr. Misc. No.7870 of 2016 by which the petitioner was granted provisional bail for a further period of six months for depositing the balance amount of Rs. 18,60,000/-.

On 29.07.2015 order passed in Cr. Misc. No. 10336 of 2015 it was submitted on behalf of the petitioner that the petitioner is ready to deposit an amount of Rs. 20 lacs before the concerned department within a period of six months. In the said period the petitioner could only deposit an amount of Rs. 1,40,000/- to the concerned department. Then modification application vide Cr. Misc. No. 7870 of 2016 was preferred for modification of the earlier order with a prayer that the said period

Patna High Court Cr.Misc. No.44550 of 2016 (3) dt.26-10-2016 2/3 be extended by another six months so that the balance amount could be deposited by the petitioner in the said six months. The first modification application was allowed.

The present modification application has been preferred seeking prayer for further extension of six months of the provisional bail so that the balance amount of Rs. 18,60,000/- could be deposited by the petitioner. The petitioner has already been granted one year time for depositing the amount, in question. Both the earlier orders were passed on the submissions made on behalf of the petitioner. This is the second modification application.

I find no reason for extending the period and the provisional bail granted to the petitioner vide order dated 30.03.2016 passed in Cr. Misc. No. 7870 of 2016 is cancelled and the present application for modification is also dismissed. The petitioner is directed to surrender in the court below within a period of four weeks from today. If the petitioner fails to do so, the court below will take all necessary steps to ensure that the petitioner is taken into judicial custody. If the petitioner surrenders within the said stipulated period of four weeks, the court below is directed to take all necessary steps to expedite the trial and conclude the same preferably within a period

Patna High Court Cr.Misc. No.44550 of 2016 (3) dt.26-10-2016 3/3 of nine months from the date of receipt/production of a copy of this order.

Counsel for the Economic Offences submits that the prosecution witnesses will be produced on the date fixed by the trial court and extend full co-operation during the pendency of the trial.
