2. The petitioner seeks regular bail in connection with Nawada (O.P. Kadirganj) P.S. Case No. 1183 of 2023 lodged on 26.07.2023 under Section 414 of the Indian Penal Code and 25(1-B)a, 26, 35 of the Arms Act.
3. As per the prosecution case, the FIR has been lodged against three named accused persons, including the present petitioner. It has been alleged in the FIR that the recovery of pistol has been made.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is in custody since 26.07.2023 having no criminal

Counsel further submits that from the seizure list, it transpire that no arms have been recovered from the possession of the petitioner rather it has been recovered from the possession of co-accused Kundan Kumar. In fact, from the possession of the petitioner only a mobile phone and a motorcycle has been recovered.
5. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nawada, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
