JUSTICE JYOTI SARAN ORAL ORDER 11-02-2015 Heard Mr. Krishna Kant Singh, learned counsel for the petitioners and learned counsel for the State. The three petitioners apprehend their arrest in connection with Barun P.S. Case No. 192 of 2012 registered for offence punishable under Sections 302 and 328/34 of the Indian Penal Code.

The three petitioners are charged with committing the murder of maternal grand mother of the informant. Mr. Singh, learned counsel for the petitioners with reference to the FIR submits that the allegation is on mere suspicion and even when the husband of the deceased is still alive

Patna High Court Cr.Misc. No.35941 of 2014 (2) dt.11-02-2015 and who has not chosen to institute any FIR that the present case has been instituted and it is considering such circumstances that two of the accused have been granted bail in Criminal Misc. No. 11694 of 2014 (Shanti Devi @ Sahanti Devi and Anr. vs. The State of Bihar).

Having heard learned counsel for the parties and taking note of the circumstances existing, let the petitioners, namely, (1) Sita Ram; (2) Muneshwar Ram and; (3) Swarup Das in the event of their arrest or surrender before the court below within four weeks from today be released on bail upon each one of them individually furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 192 of 2012 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
