The petitioner seeks bail in connection with Paroo P.S. Case No. 70 of 2019 instituted for the offence under Section(s) 270, 272, 328,467,468,471,472,419,420 and 120B/34 of the IPC and Sections 30, 30(a) 35(e), 36 and 38 of the Bihar Prohibition and Excise Act, 2016 & Section 4/6 of Trade Mark Act. Learned counsel for petitioner has submitted that there is no recovery of any illicit liquor from possession of petitioner.
In the written report, it is alleged that the informant on getting information that illicit liquor has been stored in village Sarmastpur near the Bandh went to verify the information and found one person was present in hut. He disclosed his name
Patna High Court CR. MISC. No.33153 of 2019(3) dt.18-07-2019 2/2 as Hari Rai. It is further alleged that on search of the hut total 720 bottle of foreign liquor has been recovered. It is further alleged that on the disclosure made by Hari Rai illicit liquor has been recovered from different other places as mentioned in the written report. The apprehended accused Hari Rai disclosed the name of 13 accused persons including this petitioner. Petitioner is in custody since 23.4.2019.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise Act), Muzaffarpur in connection with Paroo P.S. Case No. 70 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner.
