JUSTICE ARVIND SINGH CHANDEL ORAL ORDER 19-06-2025 At the outset, learned counsel for the petitioner submits that the issue raised by the petitioner in this case is identically covered by the judgment passed by this Court in CWJC No. 9626 of 2023, Umesh Prasad Mandal vs. The State of Bihar & Ors. which is based on terms of the judgment passed by the Division Bench of this Court in LPA No. 167 of 2016. Therefore, it is prayed by the counsel that this petition may also be disposed of in the similar terms.

2. The above prayer made by the counsel for the petitioner is not opposed by the counsel for the respondent.

3. Accordingly, this writ petition is disposed of in similar terms as per the judgment passed by the Division Bench of this Court in LPA No. 167 of 2016 as well as judgment passed by this Court in CWJC No. 9626 of 2023 Umesh Prasad Mandal vs. The State of Bihar & Ors. (supra).
