The petitioner seeks bail in a case registered for the offences punishable under sections 420, 409, 201, 202 and 204 of the Indian Penal Code.

It is alleged by the informant that the petitioner did not comply with the order of State Information Commission and also misplaced the record. Further the petitioner is alleged to have defalcated Rs.3,32,000/- which was withdrawn by him from the Account of Bihar Education Project, Begusarai for construction of school building.

It has been submitted on behalf of the petitioner that he is in custody since 24.06.2015. Charge-sheet has been

Patna High Court Cr.Misc. No.39318 of 2015 (3) dt.09-10-2015 submitted in the case. Petitioner has got no criminal antecedent. There is no allegation of tampering with the evidence against the petitioner. Petitioner has been made accused due to mistake of fact and local politics. Petitioner is ready to deposit an amount of Rs. 20,000/- (Rupees twenty thousand) in the court below which will be subject to final disposal of the case.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances of the case, the petitioner above named is directed to deposit Rs.20,000/- (Twenty thousand) in the court below which shall be subject to final disposal of the case and on such deposit, petitioner shall be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rameshwar Mishra, Judicial Magistrate, 1st Class, Begusarai in connection with Bakhri P.S. Case No. 379 of 2014.
