The petitioners are in custody in a case registered under Section 302/34 of the Indian Penal Code.
The allegation against the petitioners and other coaccused is of killing the son of the informant. On behalf of the petitioners it has been submitted that the petitioners have got no criminal antecedent. The petitioners are in custody since 5.5.2015. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioners. The petitioners are not named in the FIR. On the basis of confessional statement of co-accused, the petitioners have been falsely implicated in the present case.It is further submitted
Patna High Court Cr.Misc. No.40059 of 2015 (3) dt.16-10-2015 2/2 that other co-accused has been granted bail vide Cr. Misc. No. 38336 of 2015.
On behalf of the State, it has been submitted that the petitioners are not named in the FIR.
Considering the facts aforesaid, let above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Siwan in Barharia P.S.Case No. 101 of 2015.
