JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 21-06-2019 This application has been filed seeking direction to the respondents to return back to the petitioner the land, which was acquired for the purpose of establishing Teachers Training College.

It is the case of the petitioner that a major portion of the land of the petitioner, which was acquired in 1967 has remained unutilized and, therefore, by invoking Section 101 of the Land Acquisition Act, 1894, unutilized part of the land should be returned to the petitioner. The petitioner has brought on record letter dated 06.07.2015 written by the Principal of the Teachers Training College, Samastipur, addressed to the Deputy Collector Land Reforms. It is evident from the pleading in the

Patna High Court CWJC No.10802 of 2019(2) dt.21-06-2019 2/2 writ application itself that the land was acquired for the purpose of establishing Teachers Training College at Samastipur, which has been established. It cannot, therefore, be said that the land acquired for the purpose of establishing the College has remained unutilized.

This application has no merit. It is accordingly dismissed.
