JUSTICE SUDHIR SINGH ORAL ORDER 30-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 377 of the Indian Penal Code and 3 / 4 of the Prevention of Children of Sexual Offences Act, 2012.

Allegation against the petitioner is that he committed unnatural offence against one Shivam Kumar.

It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 4.5.2015. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioner. Petitioner has been falsely implicated in the present case. The medical report does not support the allegation made in the F.I.R. It is further submitted that petitioner may be released after completion of nine months in custody from 4.5.2015. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

No.41809 of 2015 (3) dt.30-10-2015 2 / 2 above named petitioner be released on bail after completion of nine months in custody from 4.5.2015 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions Judge-I, Patna, in connection with Shastri Nagar P.S. Case no. 244 of 2015 corresponding to Special P. S. Case no. 69 of 2015.
