Earlier prayer for bail of the petitioner was rejected by a coordinate bench of this court but submission on behalf of the petitioner is that petitioner is in jail custody since 17.4.2014 on the accusation that on his command co-accused Niranjan Rai shot fire causing injury to the deceased but up till now, his case has not been committed to the court of sessions.

Report of Sri Rakesh Kumar Yadav, Judicial Magistrate, Ist Class, Saran at Chapra reveals that charge sheet against the petitioner and two others has already been submitted by the police whereas investigation against co-accused Niranjan Rai who appears to be the main assailant has been kept pending.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of the period of
