The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code and under section 27 of the Arms Act.

The informant named 15 persons and alleged that all the 15 persons made indiscriminate firing causing death of her husband on the spot.

It is submitted that in the post mortem report one single fire arm injury was found on the body of Vivek Singh, the husband of the informant, and another lacerated wound over left elbow joint. Similarly situated accused Sanjiv Singh and Pritam Singh have already been enlarged on bail vide orders passed in Cr. Misc. Nos. 25653/ 2015 and 28335/2015 respectively and the case of petitioner stands on the same footing.

Considering the facts aforesaid and the nature of

No.41284 of 2015 (2) dt.09-09-2015 2/2 allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Naugachia, Bhagalpur in Bihpur P.S.
