JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is very much named in the first information report along with other accused persons and it is alleged that he shot fire to one Vijay Tewary, who later on, died in course of his treatment Submission on behalf of the petitioner is that the alleged occurrence appears to have taken place on account of land dispute and moreover, three injuries were found on the person of deceased, Vijay Tewary who died after 11 days of the alleged occurrence and therefore, it is not clear that the aforesaid deceased died of injuries caused by the petitioner.

I am not, at all convinced with the submission

Patna High Court Cr.Misc. No.1776 of 2016 (3) dt.16-02-2016 because it is a case of double murder and petitioner happens to be the main assailant and therefore, prayer for bail of the petitioner in connection with Nokha P.S. Case No. 220 of 2014 pending in the court of learned Sub Divisional Judicial Magistrate, Sasaram, District-Rohtas stands rejected.
