Petitioner is not named in the first information report but at para 10 of the petition, it has specifically been pleaded that the petitioner and one co-accused Om Prakash Pandey were arrested on suspicion and police got their confessional statement forcibly and except the aforesaid confessional statement, there is nothing against the petitioner.

It is pointed out on behalf of the petitioner that co-accused Om Prakash Pandey has already been granted privilege of bail whereas petitioner is in jail custody since 7.6.2015. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate,
