JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-09-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is named in the first information report and it is stated that he as well as two others were caught by the local people after the alleged occurrence and one country-made pistol as well as one live cartridge were recovered from possession of the petitioner. Furthermore, it is alleged that the petitioner and his associates made attempt to snatch mobile of the informant.
Learned counsel for the petitioner submits that as a matter of fact, the petitioner and the informant are students of the same college and an altercation had taken place between them but the informant lodged this case with exaggerated story. He further
Patna High Court Cr.Misc. No.40361 of 2015 (2) dt.09-09-2015 2/2 submits that the informant sustained simple injury, said to be caused by hard and blunt substance. It is also pointed out that the petitioner does not have any criminal antecedent and is languishing in jail custody since 07-08-2015. Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Lalganj P.S. Case No. 112 of 2015 to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur. (Hemant Kumar Srivastava, J) A.K.V./- U T
