2. This application for grant of anticipatory bail, arises out of Piyar P.S. Case No. 13 of 2025 for the offences under Sections 316(5), 318(4), 3(5) of the Bhartiya Nyay Sanhita.

As per the FIR, lodged by Manish Kumar Assistant Superintendent of Police, Eastern Sub Division, Dholi, Muzaffarpur, on 06.02.2025, the petitioner, being the Sub Post Master at Piyar Post Office, did not submit a sum of Rs. 15,33,986/- deposited by the depositors in the Post Office and thereby misappropriate huge public fund.
4. Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and in his entire career of 18 years, no complaint whatsoever was ever made against the petitioner from any body. The
Patna High Court CR. MISC. No.37872 of 2025(2) dt.10-06-2025 2/3 petitioner was on medical leave from 12.01.2025 to 31.01.2025 and joined his duty on 01.02.2025. The Petitioner was under medical treatment and due to the prolonged treatment he had extended his leave till 31.01.2025. Since, the keys of the iron safe, in which the amount was kept, could not be handed over by the petitioner, as such, the present FIR has been lodged on suspicion. After joining, the petitioner immediately handed over/deposited the sum of Rs. 15,63,986/- on 05.02.2025 which is more than the amount as mentioned in the FIR. Along with the amount the petitioner also handed over two keys of iron safe to Sunil Kumar Sahi who is the current Sub Postmaster in the Piyar Post Office.
5. Having regard to the submissions advanced by learned counsel for the parties and taking into consideration that the petitioner was on medical leave and after joining he deposited the entire amount, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two
