The petitioner seeks bail in a case registered for the offences punishable under sections 376/364 of the Indian Penal Code.

Victim filed a complaint case making allegation against Pintu Paswan that he established physical relation with her and consequently she became pregnant. She gave birth to a child. Petitioner helped the victim at the time of birth of the child. The child was handed over to the petitioner and the petitioner handed over the boy to an issueless couple.

It is submitted that the complainant herself did not want to take the child because she gave birth to a child while she was not a married.

Patna High Court Cr.Misc. No.42870 of 2015 (2) dt.17-09-2015 Considering the facts aforesaid and the fact that the petitioner is a lady, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Jamui in connection with Jamui Mahila P.S. Case no. 66 of 2014.
