The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 325, 307, 379, 354, 504/34 of the Indian Penal Code. As per prosecution case, while the informant was sitting with her son at her door, in the meantime petitioner came there armed with lathi and rod along with some ladies accused and started to abuse the informant. The petitioner gave rod blow over the head of informant's son and also assaulted the informant over her hand due to which both have sustained injury.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. There is land dispute between the parties and due to which the petitioner

Patna High Court CR. MISC. No.36366 of 2023(2) dt.03-07-2023 2/2 has falsely been implicated in this case. As per injury report, the informant sustained injury on the non vital part of the body and her son sustained injuries which is simple in nature. It is further submitted that the petitioner is languishing in judicial custody since 16.03.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Darihat P.S. Case No. 284 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate Ist Class, Dehri-onSone, Rohtas.
