The present petition has been filed for initiating a contempt proceeding against the opposite parties for willful disobedience of the order of this Court dated 28.07.2016 passed in CWJC No. 4125 of 2013 requiring the authorities to consider the petitioner's case and taking decision at their end.

3. A show cause has been filed on behalf of the opposite

Patna High Court MJC No.3848 of 2016 dt.22-02-2017 parties, Annexure-R/1 whereof, being a letter dated 06.02.2017, discloses that a final decision has been taken by the authorities and thus it is submitted that the order of this Court stands complied with.

4. It is stated that the amount due to the petitioner namely, Rs. 49,135/- for which a demand draft no. 434025 was prepared on 28.06.2013 drawn on Central Bank of India, Hajipur has now been revalidated on 07.02.2017. The original demand draft has been handed over by learned counsel for the opposite parties to learned counsel for the petitioner in Court today which has been accepted.

5. In the above view of the matter, MJC No. 3848 of 2016 stands disposed of with liberty to the petitioner that in case he is aggrieved by the order of the authorities as noticed above, he may agitate the same before an appropriate forum in accordance with law, if so advised.
