In the nature of the order that we propose to pass we do not deem it necessary to await filing of a counter affidavit.

Patna High Court CWJC No.3172 of 2018 dt.28-06-2019 2/3 The petitioner by way of present writ petition complains against the laches on the respondent authorities in the district of Sheikhpura in general and the District Magistrate, Sheikhpura in particular in not taking enough steps for ensuring completion of the scheme for laying down of the drainage at Harizan Tola within the village Nimi under Shekhopursarai P.S. in the district of Sheikhpura under Mukhya Mantri Seven Nischay Scheme sanctioned by the State Government.

It is submitted by Mr. Ritesh Kumar, learned counsel for the petitioner that though work on the scheme for laying down of the drainage has been initiated but has been abandoned midway. He submits that an application was filed by the petitioner before the District Panchyat Officer and other authorities including the Public Grievance Redressal Cell as well but which has simply become part of records and it is in these circumstances that the petitioner is before this Court.

Mr. Ritesh Kumar, learned counsel for the petitioner has made reference to Annexure-8 to submit that the grievance of the petitioner though has been found worth consideration, yet no steps have been taken for redressal of the complaint raised. Having heard learned counsel for the parties and bearing note of the grievance raised, for the present we would allow the

Patna High Court CWJC No.3172 of 2018 dt.28-06-2019 3/3 petitioner to raise his grievance before the District Magistrate, Sheikhpura, who shall accordingly consider and dispose of the same in accordance with law within a period of three months of receipt/production of a copy of this order.

It goes without saying, that should the grievance of the petitioner find merit, necessary steps be taken by the District Magistrate, Sheikhpura for ensuring completion of the scheme if initiated but abandoned as complained by the petitioner. With the above observations and direction, the writ petition is disposed of.
