ANJANA MISHRA ORAL ORDER 23-05-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with CIS No.408 of 2019 arising out of Nabinagar P.S. Case No.89 of 2019 for allegedly having committed the offence under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that admittedly, the recoveries were not made from the conscious possession of the petitioner but beside the well in the village. In view of the aforementioned facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the court below within a
