JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. In her statement, recorded u/S 164 of the Cr. P.C., the victim clearly stated that she solemnized her marriage of her own sweet will with the petitioner but learned Sessions Judge rejected the prayer for bail of the petitioner only on the ground that in the mark sheet of the victim, issued by Bihar School Examination Board, her date of birth was shown as 04-02-1998 and the aforesaid date of birth goes to show that the victim was minor at the time of alleged occurrence.

Considering the above-said submission as well as facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/-
