JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 16-05-2017 The petitioner, a registered trade union, prays for commanding the respondents to pay unemployment allowance to the workers working under Mahatma Gandhi National Rural Employment Guarantee Act, 2005 in the district of Araria together with compensation for delayed payment at the rate permissible under the said Act. It has also prayed for setting aside the inquiry reports submitted by the Programme Officers of Kursakata and
Patna High Court CWJC No.15501 of 2016 dt.16-05-2017 2/2 Forbesganj Blocks of Araria district vide letter nos. 79, 84 and 89 respectively to the Deputy Development Commissioner, Araria contending that the said reports are factually wrong, misleading and not based on reliable evidence.

I have heard learned counsel for the petitioner and perused the records.

I find that several disputed questions of fact have been raised in the present writ application which cannot be adjudicated in a summary manner on the basis of exchange of affidavits. Furthermore, no final order has been passed pursuant to the inquiry reports submitted by the Programme Officers of Kursakata and Forbesganj Blocks of Araria district. 4.
