The petitioner seeks bail in a case under Section 395 of the Indian Penal Code and under section 3⁄4 of Explosive Substance Act.

The petitioner is not named in the FIR. Nothing has been recovered from the possession of the petitioner. The petitioner is in jail since 19.06.2015 but he has not been put on T. I. Parade. The name of the petitioner surfaced in the case in the statement of Chowkidar in paragraph 280 of the case diary in which the Chowkidar disclosed that petitioner has got two cases of dacoity pending against him. It is submitted that petitioner has already been acquitted in one of the aforesaid cases. Considering the facts aforesaid and the nature of

No.39823 of 2015 (2) dt.31-08-2015 2/2 allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in Abadpur P.S. Case No. 26/2014.
