Perused the impugned order dated 21.09.2016 passed by learned District Judge, Bhagalpur in Miscellaneous Transfer Petition No.47 of 2016 whereby the learned court below refused to transfer the Title Suit No.243 of 1974 from Kahalgaon to Bhagalpur.
It appears that the suit was filed in the year 1974. After establishment of civil court at Kahalgaon two years back the case has been transferred to the court at Kahalgaon. The grievance of the petitioner is that the suit is at the stage of argument and that the Presiding Officer used vulgar language against the petitioner, as such the suit may be transferred to the court of Bhagalpur for hearing and disposal. In my opinion, this is not a ground for transfer of a case
Patna High Court C.Misc. No.1499 of 2016 (2) dt.22-12-2016 from one court to another court in the same district. Accordingly, this civil miscellaneous application is dismissed.
