The petitioner is languishing in custody in a case registered for the offences punishable under Sections 392, 397 of the Indian Penal Code.
It is alleged by the informant that three unknown motorcycle borne miscreants have robbed the cash, mobile and other articles from the informant and others. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is not named in the F.I.R. The petitioner was not apprehended from the spot. Nothing has been recovered from the conscious possession of the
Patna High Court CR. MISC. No.38257 of 2024(2) dt.17-05-2024 2/2 petitioner. The name of petitioner sprang up in this case on the basis of confessional statement of co-accused Karimullah Hasan. The petitioner has still not been put on T.I.P. The petitioner is languishing in custody since 05.02.2024. Similarly situated co-accused namely, Karimullah Hasan has already been granted bail vide order dated 18.05.2023, passed in Cr. Misc. No. 18948 of 2023.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Bachhwara P.S.
