The petitioners seek bail in a case registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code.
The petitioners are father-in-law, brother-in-law and mother-in-law of the deceased. The father of the deceased stated that his daughter was married to Kailash Gupta son of petitioner no. 1 six years ago. The informant got information about the death of his daughter and when he went there he found his daughter dead. The informant came to know that all the accused persons had assaulted his daughter.
Submission is that there is no specific allegation against the petitioners. The deceased died to due to asphyxia on account
Patna High Court Cr.Misc. No.41725 of 2015 (2) dt.15-09-2015 2/2 of strangulation and not on account of assault. Having considered the facts aforesaid and the fact that the petitioners are in-laws of the deceased, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani in Deodha P.S.
