Learned counsel for the petitioner submits that the petitioner has moved this Court for grant of regular bail even though his prayer for bail was earlier rejected vide order dated 13.06.2018 passed in Cr. Misc. No. 32457 of 2018 finding that despite framing of charge on 14.09.2018 till the date of filing of this application on or about 25.01.2019 no witness had turned up in course of trial.

Since the fatal blow is specifically attributed to this petitioner, this Court is not willing to grant regular bail to the petitioner at this stage. However, the Superintendent of Police, Katihar is directed to ensure in consultation with the Public Prosecutor of the concerned court that the prosecution witnesses

Patna High Court CR. MISC. No.33822 of 2019(2) dt.23-08-2019 2/2 are produced on the date fixed in the trial and the trial be concluded within a reasonable time, preferably within nine months.

This application stands dismissed.
