The petitioner apprehends his arrest in Sono P.S. Case No. 317 of 2018, registered for the offences punishable under Sections 363, 366(A) of the Indian Penal Code. As per the prosecution case, this petitioner with the help of other accused persons kidnapped the minor daughter of informant.

It is submitted that there was love affair between the petitioner and the victim girl and out of her own sweet will she went along with petitioner. The victim girl in her statement under Section 164 Cr.P.C has not stated anything wrong against this petitioner.

Counsel for State vehemently opposed the prayer for bail and submitted that the victim girl has full supported the

Patna High Court CR. MISC. No.45748 of 2021(7) dt.23-08-2022 2/2 prosecution version in her statement under Section 164 Cr.P.C. In view of the statement of victim girl under Section 164 Cr.P.C, I am not inclined to enlarge the petitioner abovenamed on anticipatory bail. Accordingly, the prayer for anticipatory bail is rejected.
