Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 384, 307, 341/34 of the Indian Penal Code and Sections -25(1-b)(a), 26, 27 of the Arms Act. The prosecution case, in short, is that the accused persons came and demanded rangdari from husband of the informant and on protest, assaulted him due to which, he sustained injury.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against

Patna High Court CR. MISC. No.34716 of 2020(2) dt.19-01-2021 2/2 the petitioner. The petitioner is in custody since 24-02-2020. Charge sheet in this case has already been submitted. The petitioner has been falsely implicated in the present case. There is no recovery of arms from possession of the petitioner. The allegations made in the FIR is denied by the petitioner. It has further been submitted that the petitioner may be released after completion of one year in custody.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R. He is said to have fired upon the victim.

Considering the aforesaid facts and circumstances, it is directed that after completion of one year in custody, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Nawada in connection with Kawakol P.S. Case No. 110 of 2019.
