2. The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioner who apprehends arrest in connection with Piribazar P.S. Case No. 71 of 2024, lodged on 03.06.2024, under Sections 467/468/471/419/ 420/ 120B/406 of the Indian Penal Code.
3. As per the prosecution, FIR has been lodged against six named accused persons including the present petitioner. Allegation against the present petitioner is of taking rupees two lakhs for preparing document of rupees nineteen lakhs which had been executed by a fictitious person.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that agreement executed between the informant and one Kanhaiya Jha. He submits that petitioner is deed writer of the sale deed executed by Shrikant Singh in favour of the informant and he had no role to play except for writing the contents of the sale deed. He submits that co-accused Madhuri Devi and Priyanka Kumari have been granted anticipatory bail by a Bench of this Court vide order dated 07.03.2025 passed in Cr. Misc. No.8148 of 2025. Counsel submits that he is ready to return rupees two lakhs to the informant in four installments.
5. Learned Counsel for the Informant opposes the prayer for bail and submits that the petitioner in collusion with co-accused Kanhaiya Jha had cheated the informant.
6. Learned APP for the State opposes the prayer for bail of the petitioner.
7. In the present facts and circumstances of this case, let the above named petitioner be released on Provisional Anticipatory Bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the
Patna High Court CR. MISC. No.34997 of 2025(3) dt.20-08-2025 3/3 satisfaction of Chief Judicial Magistrate, Lakhisarai, in connection with Piribazar P.S. Case No. 71 of 2024, subject to the conditions as laid down U/s 482(2) of the BNSS, 2023.
8. It is made clear that the Trial Court shall confirm the provisional anticipatory bail of the petitioner on being satisfied that the petitioner has returned rupees two lakhs in the account of the informant, in four installment, within four months.
