JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-08-2019 This application, for grant of anticipatory bail, arises out of Medni Chouki P.S. Case No. 20/19, disclosing offences under Sections 366 of the Indian Penal Code. Allegation against the petitioner is of kidnapping the daughter of the informant.
Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and have been made accused only because, they happen to be the father,

No.34929 of 2019(3) dt.07-08-2019 2/2 mother and other family members of co-accused, who alleged to have kidnapped the daughter of the informant and the real fact is that there was love affair between the son of petitioner no. 1 and the daughter of informant and they have also solemnized the marriage, which will appear from the statement of the girl recorded under Section 164 Cr.P.C., in which, she has stated that she had gone with the son of petitioner no. 1 out of her own will and married with him.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Medni Chouki P.S.
