JUSTICE MUNGESHWAR SAHOO ORAL ORDER 29-09-2016 Heard the learned counsel for the petitioner and the learned counsel for the respondent.

Perused the impugned order dated 14.07.2016 passed by District Judge, Darbhanga in Misc. (Transfer) Case No.29 of 2016. It appears that this Misc. Transfer case was filed by the plaintiff petitioner under Section 24 of the Code of Civil Procedure praying for transfer of Title Suit No.21 of 1997 for expeditious disposal as there is only one Sub Judge I Benipur. According to the learned counsel for the petitioner, the suit should be transferred to any other Sub Divisional Court for expeditious disposal.

From perusal of the impugned order, it appears that the Court below has directed the learned Sub Judge I, Benipur to dispose of the suit expeditious considering the year of the suit. Therefore, the grievance of the petitioner has already been

Patna High Court C.Misc. No.767 of 2016 (2) dt.29-09-2016 2/2 resolved by the Court below. It is admitted fact that there is only one Sub Judge in Benipur.

In such view of the matter, I do not find any jurisdictional error in the order passed by the Court below. Thus, this Civil Misc. application is dismissed.
