The petitioner seeks bail in a case instituted under Sections 341, 323, 307, 379, 506 and 509 of the Indian Penal Code and later on Section 302 of the Indian Penal Code is added. Allegation against the petitioner is that he along with others snatched golden chain from the neck of the informant and also assaulted her and her husband.
It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 12.6.2015. Charge sheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. From perusal of the F.I.R. and the case diary it is evident that there is no allegation of assault against the petitioner causing any injury upon the deceased. Petitioner is said to have snatched golden chain from the neck of the informant. Petitioner has falsely been implicated in the case due to old enmity.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri Ashutosh Pandey, learned Judicial Magistrate, Ist Class, Banka, in connection with Bounsi P.S. Case no. 60 of 2015.
