The petitioner seeks bail in Dinara P.S. Case No. 207 of 2020, registered for the offence punishable under Sections 302, 201 and 34 of the Indian Penal Code.

As per the prosecution case, petitioner along with other FIR named accused persons killed the son of informant and threw his dead body in a pond.

It is submitted on behalf of the petitioner that petitioner is father-in-law of the deceased and there is no eyewitness of the occurrence and only on suspicion he has falsely been implicated in this case. Moreover, postmortem report falsifies the prosecution case in as much as the doctor has found cause of death asphyxia and drowning and no external injury was found on the person of deceased. Patna High Court CR. MISC. No.46176 of 2021(2) dt.16-11-2021 2/2 Court vide order dated 08.04.2021 passed in Cr. Misc. No. 1012 of 2021. Petitioner is in custody since 09.03.2021 having no criminal antecedent.

Counsel for the informant vehemently opposed the prayer for bail and submitted that several witnesses have supported the prosecution case during course of investigation. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge XXII, Rohtas at Sasaram in connection with Dinara P.S.
