1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Alouli P.S. Case No.105 / 2024 (G.R. No. 788 / 2024) dated 19.03.2024 registered for the offence under Section 302, 201, 34 of the I.P.C.
3. As per the F.I.R. on 17.03.2024 at about 6:00 A.M. the informant came to know through mobile that his sister -Khushi Kumari went missing. During search, the informant got to know that dead body of a girl has been found floating in the river. The informant and his family members went to identify the body. The body was having the part below the neck and above the stomach. From the bangles and tattoo marks, it was identified to be the body of the victim Khushi Kumari. The informant alleged

The informant has further alleged that all the accused persons have murdered his sister and threw her dead body in the river. The name of the petitioner has surfaced during investigation in the confessional statement of the co-accused / Neeraj Mukhiya and Dewrat Paswan.
4. Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in the case due to local politics. The petitioner is not named in the F.I.R. and his name has come on the basis of confessional statement of the co-accused / Neeraj Mukhiya and Dewvrat Pawan. He next submits that compromise between the parties has already taken place. Copy of the compromise petition is annexed as Anenxure2 to the supplementary affidavit.
5. I have heard learned counsel for the parties and perused the material on record. Paragraph no. 48 of the case diary contains seizure list which shows recovery of axe, knife and a green coloured plastic bucke from the Aara mill of the petitioner. Although the petitioner is not named in the F.I.R. but his name has come in the confessional statement of the coaccused / Neeraj Mukhiya and Dewvrat Paswan. Taking into

No.40154 of 2025(4) dt.17-10-2025 3/3 consideration the gravity of the offence and the fact that name of the petitioner has been disclosed by the co-accused during the course of investigation which may be the basis of further investigation against the petitioner, accordingly, I am not inclined to grant anticipatory bail to the petitioner. The same is rejected.
