The petitioner seeks regular bail in connection with Piprahi P.S. Case No. 33 of 2016 for the offence registered under Sections 420, 188/34 of the Indian Penal Code. The allegation in the FIR as per the written report of the Block Education Officer, Piprahi is that the petitioner and other Panchayat Secretaries did not comply with the order of the Hon'ble High Court regarding producing the records of the teachers appointed since 2006.
The learned senior counsel for the petitioner has submitted that the petitioner is innocent, has been falsely implicated in the present case and he is languishing in custody since 23.06.2021. The learned senior counsel for the petitioner has further submitted that similarly situated co-accused person
Patna High Court CR. MISC. No.46818 of 2021(4) dt.28-02-2022 2/3 has already been granted anticipatory bail vide order dated 17.02.2022 passed by a coordinate Bench of this Court in Criminal Misc. No. 31335 of 2021. The learned senior counsel for the petitioner has next submitted by referring to paragraph no. 6 onwards of the present petition that the petitioner had in fact sent all the documents available with him, however, after some delay.
Per contra, the learned counsel for the State has vehemently opposed the prayer for bail.
Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the parity of the case of the petitioner with that of the co-accused person who has already been granted anticipatory bail by a coordinate Bench of this Court apart from the fact that the petitioner has categorically stated in the present petition that he had sent the requisite documents but after some delay, I deem it fit and proper to direct for release of the petitioner herein on regular bail.
Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the
