The petitioner seeks bail in Narpatganj(Basmatiya) P.S. Case No.281 of 2019 registered under Sections 302, 120B and 34 of the Indian Penal Code.

The informant named 66 persons in the F.I.R. and alleged that accused persons brutally and mercilessly assaulted his father and the brother and killed them.

The learned counsel for the petitioner submits that Safitullah, one of the named accused has been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 16.07.2019 passed in Cr. Misc. No.43593 of 2019 and about ten other accused persons were granted regular bail vide order passed in Cr. Misc. No.18719 of 2020, Cr. Misc. No.42249 of 2019, Cr. Misc. No.50654 of 2019 and Cr. Misc.

Patna High Court CR. MISC. No.34337 of 2020(2) dt.05-01-2021 2/2 No.51154 of 2019.

On the face of it, it appears that it is a case of mob lynching as the father and the brother of the informant were brutally and mercilessly assaulted till they died but since similarly 11 co-accused have been granted bail and the case of the petitioner stands on the same footing and petitioner is in jail since May, 2020, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Narpatganj(Basmatiya) P.S.
