The petitioner is languishing in custody since 6.2.2019 in a case registered for the offences punishable under Sections 25(1B) a, 26 and 35 of the Arms Act. It is alleged that one country made pistol was recovered from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner is accused in one other case of Excise Act and he has been roped in as an accused in the present case, merely on the basis of earlier accusation of a similar nature against him. Learned APP submits that recovery of a pistol has been made from the possession of the petitioner.

Considering the nature of recovery, the fact that investigation has concluded and the period in custody, let the petitioner above named be released on bail on furnishing bail

Patna High Court CR. MISC. No.34811 of 2019(2) dt.28-05-2019 2/2 bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM I-cum-I/c CJM, Nalanda at Biharsharif in connection with Rajgir P.S. Case No.42 of 2019.
