Let the defect(s), if any, as pointed out by the office, be removed within four weeks.

The case is registered under sections 147, 148, 149, 341, 323, 504, 506 and 307 of the Indian Penal Code read with Section 27 of the Arms Act, in connection with Bagengola P.S. Case No. 15 of 2022.

As per the prosecution story, the informant has alleged that when he was cleaning public drainage system, the accused persons including the petitioner herein came and started abusing him and thereafter, the allegation against this petitioner is that he opened fire which hit his palm and as a result whereof he was injured.

Patna High Court CR. MISC. No.36334 of 2022(2) dt.19-09-2022 2/2 Learned counsel for the petitioner submits that there is counter version also to the case lodged by the wife of the present petitioner. It is his further submission that the doctors have found the injury on the chest.

The learned APP on the other hand submits that there is injury on the wrist which was found to be grievous in nature, inasmuch as, three fingers have been found to be fractured and as such he submits that the petitioner does not deserve bail.

Considering the fact that there is specific allegation of opening fire on the petitioner which caused fracture in three fingers of the informant, this Court for the present is not inclined to grant him the privilege of bail which is accordingly rejected.
