JUSTICE SUDHIR SINGH ORAL ORDER 15-10-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is languishing in custody since 22.10.2014 in connection with Runnisaidpur P.S. Case No. 290 of 2012 for the offences instituted under Sections 3⁄4 of the Explosive Substance Act, 17 of C.LA. Act and 10/13 of U.A.P. Act. It is alleged that the petitioner and others fixed land mines six months ago to damage the police forces and also to loot the arms and ammunitions.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.10.2014 and the charge sheet has been submitted in the case. There is no allegation of tampering with the evidence against the petitioner. He has remained in
Patna High Court Cr.Misc. No.42299 of 2015 (3) dt.15-10-2015 2/2 custody for one year. The name of the petitioner has come in the FIR on the basis of confessional statement of co-accused. There is no direct or indirect evidence against the petitioner for committing the alleged occurrence except for confession of the co-accused. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi, in connection with Runnisaidpur P.S. Case No. 290 of 2012.
