In the present case, the petitioner is challenging the order dated 30.4.2016 issued under the signature of District Programme Officer, Lakhisarai, whereby and whereunder, the appointment of the petitioner as Anganbari Sevika has been canceled and, in her place, the respondent no.6, Kumkum Devi has been selected.
Learned counsel for the petitioner submits that the respondent no.6 is not the resident of ward no.8 rather she is the resident of ward no.9, the private respondent no.6 has wrongly
Patna High Court CWJC No.16330 of 2016 dt.27-11-2018 2/2 been appointed in her place and wrongly the claim of the petitioner has been rejected by the District Programme Officer. There is a provision of appeal.
Let the petitioner should approach to the appellate authority who will examine as to whether the petitioner is the resident of Ward No.8 or Ward No.9 and will decide the matter in accordance with law, after giving a notice to the private respondent no.6, within a period of six months from the date of filing of the appeal by the petitioner.
