JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-09-2015 Heard learned counsels for the petitioner and the State. The petitioner being the father of the husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 494, 498A, 354, 504 and 506/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The basic accusation is of torture and performing second marriage by the son of the petitioner. It is specifically alleged against the petitioner that he made attempt to outrage the modesty of the informant.
It is submitted by learned counsel for the petitioner that informant was earlier married with one Shankar Swarnkar against whom the informant filed Complaint Case No. 349C of 2011 levelling accusation under Section 498A IPC and thereafter by
Patna High Court Cr.Misc. No.41391 of 2015 (2) dt.02-09-2015 2/2 concealing all these facts, she performed marriage with the son of the petitioner to which the petitioner is not a party and was opposing the same, hence the accusation has been levelled against the petitioner.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Madhepura in connection with Madhepura Mahila P.S. Case No. 18 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
