In this case, the petitioner is seeking anticipatory bail in connection with Khagaria (Chitragupta Nagar) P.S. Case No.735 of 2019 registered for the offence under Sections 341, 323, 504, 379, 506 and 307/34 of the Indian Penal Code under Section 27 of the Arms Act.

As per the F.I.R. the informant is running a tea shop. As she was objecting illegal acts of this petitioner and others, the petitioner and one Gunju Sahni came to her tea shop along with four unknown persons and started hurling abuses. When the informant objected the same, they misbehaved with her and also assaulted her.

When this Court has asked learned counsel for the informant about the nature of injury sustained by the informant,

Considering the aforesaid facts, let the abovenamed petitioner, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria (Chitragupta Nagar) P.S. Case no.735 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. This is also subject to the conditions that one of the bailors will be a close relative of the petitioner and whenever the police will call the petitioner for the purposes of investigation and interrogation, he will remain present for the investigation. In the event of being absent on two consecutive dates without reasonable explanation, the present order will be treated to have been cancelled.
