====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 19-06-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 498(A)/34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is the husband of the opposite party no. 2/informant. It is next submitted that the marriage in between the petitioner and the informant was solemnized in year 2021. It is further submitted that this Court by order dated 29.11.2022 had issued notice to the opposite party no. 2/informant. It is also submitted that notices were filed in time and from perusal of the office report, it would manifest that opposite party no. 2/informant

Patna High Court CR. MISC. No.36719 of 2022(3) dt.19-06-2023 2/2 despite receiving the notice personally has chosen not to contest the case. It is further submitted that petitioner is always willing and ready to keep the opposite party no. 2/informant with full dignity and honour but the informant herself has deserted the petitioner or else she would appear before this Court in pursuance of the notice issued. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Buxar (Mahila) P.S. Case No. 63 of 2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
