The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code.
The informant is not an eye witness of the occurrence. The informant only suspected that the petitioner and other accused persons killed his mother only because the wife of Ganesh Sao died a year ago and Ganesh Sao and others had suspected that informant's mother practiced witchcraft and that is why wife of Ganesh Sao died. Except suspicion, there is no material against the petitioner and similarly situated accused Dilip Kumar, Chhotu Sao, Suresh Ravidas and Mantu Das have already been enlarged on bail.
Considering the facts aforesaid and the nature of
Patna High Court Cr.Misc. No.41548 of 2015 (2) dt.10-09-2015 2/2 allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in Rajauli P.S. Case No. 123 of 2014.
