JUSTICE MUNGESHWAR SAHOO ORAL ORDER 02-02-2017 The learned counsel Mr. Mahesh Prasad II for the petitioner submitted that the review application which is Annexure-6 filed by the respondent under Section 114 CPC has been allowed i.e., review has been granted.
In view of the submission of the learned counsel for the petitioner, the impugned order is appealable order under Order 43 Rule 1 Clause (w) CPC. Therefore, the learned counsel for the petitioner seeks permission to convert this civil misc. application into misc. appeal under Order 43 Rule 1 Clause (w) CPC. Accordingly, the learned counsel for the petitioner is permitted to convert this civil misc. application into Misc. Appeal under Order 43 Rule 1 Clause (w) CPC.
